Complete ineptitude. Gorsuch asked about American Indians and he hadn't thought of an answer.

This is one case where not even the FEDSOC Supreme Court can justify such a naked contempt for the Constitution.

To be completely fair to Sauer, there's no way to come prepare adequately to defend a stupid, ahistorical, illogical, bad faith argument. Winning on one depends on stupid or dishonest judges.
