Judge Carl Nichols, who was appointed by Trump in 2019, says Trumps Exec Order on Mail in balloting can go forward denying a Dem complaint. Nichols argues that nothing has changed yet, the Feds haven't produced any fraudulent lists of people allowed to vote, and the Post Office hasn't changed any rules on mail in voting as a result of it, so it's "too early" for the Dems to complain.

So they have to wait until closer to the midterms when the GOP intentionally breaks the mail in system and then they can complain but by then of course it will be too close to the elections

Dems are appealing of course but legal experts are calling Nichols' ruling absolutely absurd. An Exec Order that changes federal and state election laws without any actual authority to do so clearly harms people.

In effect Judge Nichols is signalling that they'll allow Trump to put in the "Save Act" by decree without actually having to get congressional approval
