In that case he was giving an advisory opinion. Not addressing the case at hand but making a road map on how they might be able to attain their objectives based on facts and a case not before the court.
One of the first things you learn in Federal Courts and Constitutional law is that you must have a justiciable controversy, and that courts should never give advisory opinions or issue hypothetical rulings on cases not before the court.
