Yes, if they do a good job of citing performance issues and/ dereliction of duty if not actual cause. He will incur legal bills and bad publicity as evidence would be gathered & presented publicly. Evidence & publicity that could make him unhireable going forward.
Not sure how he can claim punitive damages...for making him sue to make a case for a ridiculous contract? That would shine the light...in court...on how his contract was approved. Plus, it's not like he would have a case to get 3x damages.
If anything, withholding his pay out would encourage a negotiated buyout and quiet departure. Meanwhile, prospective ADs and coaches will understand that they will now be held accountable by a previously feckless university.
