The Justice Department has filed felony assault charges against a man who prosecutors say scootered up to two National Guard soldiers at D.C.'s Union Station and spat on them.

The statement of facts aleges that on Friday, Aug. 22, Scott J. Pichon was riding an electric scooter past two Guard soldiers when Sergeant Robert Underwood claims he heard the "man make a noise like he was coughing up mucus." Sgt. Underwood alleged that he observed Pichon spit "a mixture of saliva and mucus" on the men.
It allegedly landed "on the chest and face area." The man didn't stop the scooter as the incident unfolded, the claim said. The surveillance video shows Pichon riding by on his scooter and the men "reacting" to being allegedly spat on, but it doesn't appear to show actual spit flying toward the men.
