The "NIL" referred to in the article is the money intended for revenue sharing.
The NIL most of us have been talking about is the pay-for-play money disbursed from collectives.
And then of course there is the legitimate, "Ed O'Bannon" NIL. Making commercials for Wendy's, etc.
So, there's revenue sharing, pay-for-play, and true NIL, all being called the same thing.
As you say, it's the revenue sharing version that could trigger Title IX. And as others have said, the issue will undoubtedly end up in the federal courts, maybe even SCOTUS.
I wonder though, if states (let's be honest, our state) will try to stick their nose in it and try to apply state anti-discrimination laws or issue directives through the Regents. If so, UCLA football is permanently headed for the B1G cellar, essentially down for the count.
