How do you know there even is a buyout?

By "buyout" I mean some kind of penalty clause, as opposed to just paying back what you've already been paid. You already admit that the reporting does not make clear that there is a buyout, yet you think the buyout should be paid. What if the buyout is structured in such a way that a court could say it is unenforceable? If you know legal principles you should know that things can get very un-simple real quick.

What if the contract had language to the effect of "while you are engaged as a member of the Tennessee football program you will be paid $X per month for your participation in A, B, and C activities relating to the use of your NIL"?

Or if for a finite term, how do you know when the calendar year/term of the contract ends? Or if there are any clauses that one side can terminate or renegotiate the contract at the end of a certain period?

For example, if you sign a QB for $2 million a year but after year 1 or 2 you decide he can't hit the broad side of a barn? You're going to want some flexibility.

And how do you know Tennessee even wants to sue a player who QB'd them to the playoffs when it might damage their reputation in recruiting circles or even among their current roster?

I'm not objecting to your belief that there could be some liability somewhere, only to your certainty about things. No matter how much you post about what will "surely" happen or who is "entitled" to what, you don't know.

Nothing against Arkansas, but they play in the SEC and their QB coach is Bobby Petrino. I'd like to know a little more before concluding what they are entitled to.
