box, IMO. Conservatives have always been keen on using any marginally legal interpretation to undermine the Democratic Party no matter how much they have to stretch credulity: see Mitch McConnell's back and forth on what constitutes "too close to elections" in bringing a supreme court nomination to the floor, for instance.

So under that interpretation, at least those counter-examples fold into the notion that the Supreme Court is simply pre-Trump/pre-MAGA conservatism on steroids (which, obviously, is bad enough).
