Because if so, it might be too much of an ask for the state to open doors to institutions they have no regulatory control over. I think at most what you can argue for would be specific exemptions to be made in cases of specific schools or maybe reciprocation rules between states whose regulatory principles are aligned.
If there's no state support involved I don't know what business it is of the state to restrict where you send your kids to school whether it is for therapeutic reasons or sports reasons (we have neighbors who do that with their kids for sports reasons). Unless of course the primary concern is conversion therapy for sexual orientation, which is its own can of worms
