In some cases the state pays the tuition, or a part of it.

They do have regulatory control. See below.

And in our kid’s case the district sent people out to evaluate the program, evaluate the appropriateness of that school for our kid, evaluate how our kid was doing at the school through testing, observation, and monthly phone calls with school staff. Iirc, the district personnel made three trips to the kid’s school. If at any time they found that kid’s needs weren’t being met, or that safety measures weren’t sufficient, they’d have cut off the funding.
