In every jurisdiction below the federal level, we elect a separate officer in charge of prosecution. States have Attorneys General; counties have District Attorneys. They are elected by the people separately from the executive.

You would make the Department of Justice the 4th branch, handling prosecution and create a new Department of Law Enforcement that would remain within the Presidential Branch.

The DOJ would still be governed by an Attorney General, but one that is non-partisan and gets elected for a four-year term. I would time such an election to the mid-term elections--to limit the influence a President would have on the choice. And no electoral college nonsense--it's whoever gets the most votes. The AG would have rank equivalent to the VP, Speaker of the House, and Chief Justice.

If there is a vacancy in the office of AG, follow the same procedure as when the VP office is vacant.

To me, the problem of having an AG whose boss is the President is becoming too obvious. That needs to be fixed.
