IMHO, Gasparino's INTENT in putting up his elbow/forearm was to knock the ball out of the 3rd baseman's glove. After his arm contacted the glove -- and didn't knock the ball out, the motion continued and did strike the Oregon player. To call what Gasparino did "malicious" is just plain ridiculous.
