I've been contending that they have fully transitioned into being a political entity and IMO, the turning point was the "The president can do no wrong" decision -- or it may be traced to something earlier, I dunno. What I've been trying to track since then is to identify what the shape of the politics is, how they envision the new power relations ought to be, etc.
Others (fan being one of them) see them as a fundamentally legal entity but either adopting a warped legal doctrine (I don't understand law enough to be able to tell who fits that mold) or letting politics seep into their decisions in small doses (I think that's where fan sits).
They are, at the end of the day, their own locus of power and they seem to be behaving maddeningly inconsistent. I may have overshot on how fully political they are, to some extent, but I still believe that they are a fundamentally political branch of the government that remains wobbly in its politics. That tells me there is one more ingredient in their politics that I'm not seeing yet.
